From the article: “Prosecutors allege that McClarin first strangled his cell mate on July 7 until the victim was physically helpless. He then is accused of sodomizing the man, who is in his 30s. The following day, McClarin again allegedly forcibly assaulted the cell mate, the indictment states.”
As horrific as this sounds, the attorney representing the defendant said that upon further investigation, these were false allegations arising from a disagreement between the inmates and that any sexual contact was consensual.
Equally scary is this:
Although it is rare for such sexual assaults among inmates to result in prosecutions, officials with the state Department of Corrections and Community Supervision could not provide statistics Friday regarding how many such allegations are reported, investigated and prosecuted.
I am really hoping that the NY DOC was just choosing to be silent. How do you not know how many rape allegations are reported, investigated, and prosecuted?
