Conviction Upheld in Inmate Sex Case

“A Fond du Lac nurse who was convicted last April of having a sexual relationship with an inmate at the Kettle Moraine Correctional Institution has lost her appeal.  46 year old Laurie Blum was tried in Sheboygan County Court, was found guilty by Judge Timothy Van Akkeren, was sentenced to 3 years probation and ordered to do 40 hours of community service.  Blum admitted to engaging in sexual activity at the prison unit six different times.  She appealed on grounds that her mental state at the time made her incapable of giving consent, making the inmate subject to prosecution for sexual assault.  She also argued that, as a nurse, she had no authority over the inmate and, therefore, the law criminalizing sexual activity between staff and inmates is unconstitutional in her case.  The Appeals Court today disagreed on all counts and affirmed Van Akkeren’s conviction.”
